PURCHASE PROCESS FOR AN ARTWORK BY RITA MANCESTI
The User may order and acquire the Artworks offered on the Site. This sale will be at a fixed price. The price includes all taxes and resale right, but excludes any packaging and delivery costs. The description and presentation of the Artworks are indicative. The artist takes all precautions to ensure they correspond as closely as possible to reality and includes a short demo video upon request, as well as a zoom function that allows viewing the painterly touch. The artworks are therefore presumed to be well known to the buyer. The artist cannot be held responsible if an Artwork does not meet the buyer’s expectations.
When placing an order, the User must provide their country of residence and postal address, their first and last name, their email address, and, if applicable, their company details, as well as their phone number. Their billing information will also be collected to enable the finalization of the order and payment for the Artworks they acquire. Ownership of the ordered Artworks will be transferred upon payment of the Artwork’s price. No collection from the artist’s studio or delivery can be made before full and complete receipt of payment for the Artwork’s price.
In the event that an Artwork is sold in a gallery simultaneously with its online sale, the online sale would be rendered null and void. In this case, the buyer will be immediately reimbursed for the purchase price of the Artwork. The artist implements all means at her disposal to avoid such circumstances and cannot be held responsible for any damage or loss resulting from the nullity of the sale.
The Artworks offered for sale are generally not framed. They feature a hanging system on the back, a dark grey/blue painted finish on all 4 sides, and can be hung on the wall as is, allowing you time to decide whether a frame is desired or not.

RIGHT OF RETURN
Please note – paintings sent cannot be returned. The e-shop describes them precisely in terms of size, and by means of a video on request also revealing the back of the painting. Each Artwork is listed in a catalogue raisonné and the artist includes a hand-signed certificate of authenticity. The artist Rita Mancesti personally checks the condition of the painting and uses professional art shippers (moviiu.com based in Geneva) who have valid transport insurance and ensure that packaging and delivery are in perfect condition upon receipt.
However, be careful not to use a cutter when unpacking.
The paintings are created using oil technique on a beige linen/cotton canvas, and protected against sun and dirt by a transparent varnish. In case of a stretched canvas, the 8 keys on the back can be gently tapped with a hammer to re-tension the canvas. It is advisable to consult a framer who will ensure that the tension is evenly distributed at all 4 corners of the artwork. If, however, the buyer wishes to return the artwork for exceptional reasons and after sending an email to the artist’s contact form, the return is at the buyer’s expense and risk. No exchange will take place if the Artwork is not returned in its original condition, particularly if the Artwork is damaged due to transport or by the buyer, or if the Artwork is soiled (stains, fingerprints, etc.). In all cases, there will be no refund, but an exchange would be offered within a maximum of 10 working days. Beyond this time, the artist will no longer consider an exchange of artworks. RITA MANCESTI’S INTELLECTUAL PROPERTY RIGHTS
The domain name of this Site belongs to the artist, as do the images featured therein. As such, unless with prior written authorization from the artist, the use of all or part of the Site, particularly by downloading, transmitting, reproducing, representing, or distributing for purposes other than the User’s personal and private non-commercial use, is strictly prohibited. Any reproduction of images, texts, trademarks, and/or logos appearing on the site, by any means whatsoever, without prior written authorization from the artist, is strictly prohibited. Similarly, any reproduction or use of any Artwork appearing on the site, in whole or in part, by any means whatsoever, without prior written authorization from the artist, is contrary to law and is strictly prohibited. Violation of the artist’s rights constitutes an act of infringement liable to incur the civil and/or criminal liability of the perpetrator of such an infringement. The User is prohibited from any action or act likely to directly or indirectly infringe the artist’s intellectual property rights. Respect the Artist’s original creation. In case of doubt or desire to collaborate on a project, do not hesitate to contact Rita Mancesti, who will gladly respond or seek advice from her legal protection to determine the clauses.
